Filing a DMCA Takedown Notice

  • Accuracy statement: Include a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf
  • Physical or electronic signature: Provide your physical or electronic signature (typing your full legal name is acceptable as an electronic signature)

What Happens After We Receive Your Notice

Upon receiving a valid DMCA takedown notice that meets all legal requirements, we will:

  • Promptly investigate the claim
  • Remove or disable access to the allegedly infringing material if the claim appears valid
  • Notify the user who posted the content (if applicable) that we have removed or disabled access to the material
  • Take reasonable steps to notify the alleged infringer of the complaint

We typically respond to valid DMCA notices within 2-5 business days. Please note that submitting a false or fraudulent DMCA notice may result in legal liability.

Filing a DMCA Counter-Notice

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may file a DMCA counter-notice with our DMCA Agent containing the following information:

  • Your contact information: Include your full legal name, mailing address, telephone number, and email address
  • Identification of removed material: Describe the material that was removed or disabled and the location where it appeared before removal
  • Good faith statement: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Consent to jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Eastern District of Virginia if your address is outside the United States), and that you will accept service of process from the person who filed the original DMCA notice or an agent of that person
  • Physical or electronic signature: Provide your physical or electronic signature

Upon receiving a valid counter-notice, we will forward it to the person who filed the original DMCA notice. If the original complainant does not file a court action seeking an order to restrain you from engaging in infringing activity within 10-14 business days, we may restore the removed material.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Bootstrapper Toolbox has adopted a policy of terminating, in appropriate circumstances, users or account holders who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to our website and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Limitations and Good Faith

Please note the following important points:

  • Misrepresentation: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to liability
  • Legal Advice: This policy is not legal advice. If you have questions about copyright law or DMCA procedures, consult with an attorney
  • Fair Use: Before submitting a DMCA notice, please consider whether the use might be protected under fair use doctrine
  • User-Generated Content: We are not responsible for user-generated content, but we will respond appropriately to valid DMCA notices
